Terms of Service for Mobile Top-Up Services via Digitt+ Platform

These terms and conditions constitute a legally binding agreement between you as the customer (the “Customer“) and Akhtar Fuiou Technologies (AFT), the provider of the Digitt+ Platform (“Digitt+”). By proceeding to use the external Vendor’s Mobile Top-Up Services (the “Services”), you are aggreging to be bound by the following terms and conditions (the “Terms of Service“).  

 

1. Definitions

Applicable Laws” means all applicable federal and provincial statutes, regulations, judicial decisions, rules, orders, and requirements of any Regulatory Authority, as such statutes, regulations, rules, order, requirements, or bylaws may be amended or in effect from time to time during the term of these Terms of Service; 

“Commencement Date” means the date on which the Services are made available to the Customers of AFT which shall be [•] [months / weeks / days] from the Effective Date or such other date as mutually agreed by both Parties in writing; 

“Customer” means a customer of AFT to whom Services are provided through Digitt+; 

Customer Data” means and includes any and all personally identifiable information and financial data of the Customers which are supplied or made accessible to AFT or the Vendor, by the Customer for the purposes of the Services;  

Regulatory Authority” shall mean any local, provincial, or federal agency, office or supervising entity, or any other authority having jurisdiction over AFT, in such a manner as to impact the operations or activity being contemplated under this Agreement.  

Services” has the meaning given to it under Clause 2 below;  

 

2. Service Overview 

2.1 The Services allow Digitt+ customers to send mobile top-ups to recipients in over 150 countries using Vendor’s platform. 

2.2 AFT acts as a payment mediator, enabling secure and efficient transactions. 

 

3. Role and Scope of AFT 

3.1 AFT acts solely as a payment mediator for the transactions conducted through Digitt+. 

3.2 AFT is not responsible for the delivery of the Services. 

 

4. Payment 

4.1 Customers shall be responsible for ensuring the accuracy of the recipient’s details before initiating a transaction. 

4.2 AFT shall not be liable for errors resulting from incorrect information provided by the Customer.

4.3 Once a payment is successfully processed, AFT shall not be responsible for the reversal or return of the amount.  

 

5. Fees and Charges 

5.1 AFT will charge a transaction fee of [•]% for the use of the Services. The Fee will be displayed before the transaction is completed. 

 

6. Limitation of AFT’s Liability 

6.1 AFT’s role is limited to facilitation of the transaction as a payment mediator.  

6.2 AFT is not liable for any issues related to the delivery of the Services, including but not limited to delays, non-delivery, or incorrect recharge amounts. 

6.3 AFT is not liable for consequential or incidental damages. 

6.4 AFT is exempt from liability in cases of unforeseen circumstances beyond control. 

6.5 AFT is not responsible for communication errors between Customers and the Vendor. 

 

7. Customer Information Transfer and Consent 

7.1 By accepting these Terms of Service, the Customer hereby authorizes and consents to the transfer of their personal, transactional, and account-related information (hereinafter referred to as “Customer Information”) by AFT to the Vendor This transfer is essential for facilitating payments, processing transactions, and ensuring compliance with Applicable Laws, including legal, regulatory, and operational obligations. 

7.2 The Customer acknowledges that such information may include, but is not limited to the following: 

 

  • Name; 
  • Contact details; 
  • Payment history; 
  • Transaction records; 
  • Account status and related data; and 
  • Any other relevant information necessary for the Vendor to process or authenticate the Customer’s financial activities. This transfer may also include data required for fraud prevention, dispute resolution, or the performance of financial obligations.

7.3 The Customer understands and agrees that AFT, in its capacity as a payment mediator, may disclose such information to the Vendor in a manner consistent with any privacy laws and data protection regulations applicable to the jurisdiction in which the Services are provided. AFT is committed to safeguarding the Customer’s information and will take reasonable measures to ensure that it is transferred securely and only for the purposes outlined herein. 

7.4 By accepting these Terms of Service, the Customer grants explicit consent to AFT for the transfer of data to the Vendor, understanding that this transfer is essential for the operation of AFT’s Services and to ensure the smooth execution of transactions. The Customer further agrees that any communication, inquiries, or issues relating to the processing of their Customer Information by the Vendor shall be addressed directly with the Vendor, and AFT shall not be liable for any delays, disputes, or complications arising from the Vendor’s handling of such information. 

7.5 The Customer shall provide information that is true, accurate and complete 

7.6 This consent remains in effect for the duration of the Customer’s use of the Services and may be revoked by providing written notice to AFT, subject to the Terms of Service applicable to the cancellation of the Services.  

 

8. Amendments to Terms  

8.1 AFT reserves the right to revise these Terms of Service. Customers will be notified of any changes via Digitt+ or email.  

 

9. Governing Law and Jurisdiction 

These Terms of Service shall be governed by and construed in accordance with the laws of Islamic Republic of Pakistan.

10.1 For any queries, support, or assistance related to this Services, please contact AFT’s customer service through Digitt+, email, or helpline.
